Abstract
- An essay is presented which reflects on the creation of the U.S. Federal Rules of Civil Procedure (Federal Rules) in 1938, focusing on litigation in America involving civil rights and corporate laws, as well as information about the legal discovery process and proportionality in the law. Edward Bellamy's book "Looking Backward" is mentioned, along with the alleged attitudes of the framers of America's Federal Rules. The U.S. Rules Enabling Act and American evidence laws are also examined.
