Abstract

The article has two main parts: In the first one, which deals with methodological (or meta-theoretical) issues within legal philosophy, the authors defend a so-called "methodological contextualism " approach according to which the projects of developing a descriptive concept of law, or a prescriptive or normative one, are both plausible and legitimate. Based on this approach, in the second part a preponderantly normative notion of law is articulated. This is done by including the "political obligation" and the observance of the principles of the Rule of Law as parts of the concept of law itself. [ABSTRACT FROM AUTHOR]
