Abstract
- The article discusses an alleged conspiracy where law firm Jones Day allegedly drove Detroit, Michigan into bankruptcy as a way to shed the city's responsibilities to pensioners. The alleged conspiracy began with a 2011 law review article by Jones Day partner Jeffrey Ellman and associate Daniel Merrett exploring how municipalities can use Chapter 9 to solve pension woes. U.S. Bankruptcy Judge Steven Rhodes ruled that the filing was made in good faith, a requirement for Chapter 9 eligibility.
