Abstract
- The article explores the role of juries in U.S. patent validity decisions. The author begins by tracing the origins U.S. patent practice to the right to a jury trial found in English law during the foundational period of the U.S., and goes on to outline the history of U.S. patent litigation and legislation. Also explored is the relationship between the Seventh Amendment of the U.S. Constitution and patent validity. Other topics discussed include equity and U.S. public administration.
