Abstract

The article analyses the influence of the South African Consumer Protection Act 68 of 2008 on the common law warranty against eviction. It informs that the act is applicable to the supply of goods and services in an ordinary course of business. It adds that the act is not applicable in the case of consumer sales agreements where the consumer is a juristic person with an annual turnover equaling or exceeding the threshold value. It mentions that the implementation of the act has great implications for the South African common law of sale.
