Abstract
- The article discusses the 2012 New York Court of Appeals case Yonaty v. Mincolla which deals with tort law and the defamation per se doctrine in relation to statements imputing homosexuality. The plaintiff filed a lawsuit claiming intentional infliction of emotional distress (IIED), defamation, and prima facie tort (PFT) after the defendant allegedly spread rumors about the plaintiff's sexual orientation. The defendant's summary judgment motion was granted in regards to the IIED and PFT claims.
