Abstract

The article discusses the laws controlling assistive reproductive technology (ART) in Australia. The laws control the development and use of embryos created specifically for the purpose of reproduction. The state of Victoria imposes mandatory child protection and criminal record checks on all people who want to use ART services; and there is a presumption against treatment which is applicable if a criminal record check specifies criminal charges against the women or her partner. In Australia, there are federal guidelines on how a pre-gestated embryo may be used after it is frozen, and the frozen embryo can be stored for a maximum period of 10 years.
