Abstract

The article focuses on the legal ramifications of the classification of trichloroethylene as a carcinogenic by the U.S. Environmental Protection Agency (EPA). The substance enters the EPA Integrated Risk Information System as a hazardous substance. The action of EPA is widely considered as a classification based on estimated risk and purpose, not a pronouncement of a presumption on proximate cause. As such, the decision will be cited in disease causation cases.
