Abstract
- The article discusses the court case O'Connell v. Turner Construction Company which deals with the liability difference between construction managers and general contractors. The theories of construction negligence under Section 414 and premises liability under Section 343 were contained in plaintiff Lawrence O'Connell's lawsuit against Turner. An appellate court analyzed the case in terms of premises liability theory and found that Turner had no viable cause of action.
