Abstract

The article discusses the impact of public discourse about the September 11, 2011 Terrorist Attacks on the U.S. judicial branch, with a focus on habeas corpus litigation. The article uses terminology in the book "Archaeology of Knowledge" by Michel Foucault to discuss the ways in which discursive practices have influenced the judicial role in habeas corpus legislation such as Hamdi v. Rumsfeld and Boumediene v. Bush.
