Abstract: The article discusses a court case wherein Arista Records LLC has sued Launch Media Inc. of violating the U.S. Digital Millennium Copyright Act (DMCA) by infringing sound recording copyrights of BMG Music Entertainment from 1999-2001 for its Internet radio website LAUNCHcast. According to BMG, LAUNCHcast is required to pay licensing fees for its interactive service. Moreover, Southern District of New York has found that LAUNCHcast is not an interactive service, so, it is not liable for the fees.
