Abstract
- The article discusses the Fujifilm Corp. v. Benun court case regarding patent exhaustion. It states that Benun contended that the sale of the single-use camera in foreign country and subsequently sold in the U.S. invokes the doctrine of exhaustion. However, the Federal Circuit argues that because of the sale in foreign country, the doctrine of exhaustion cannot be applied and selling of it in the U.S. constitute infringement.
