Abstract

The article presents a commentary on the R. v. Conway case in the Canadian Supreme Court which raised the issue of the role of administrative tribunals in deciding Charter of Rights and Freedoms claims. According to the author, the Conway case can be considered as a restatement and consolidation of the law. A description of facts underlying the case is provided, as well as the decisions of both the Ontario Review Board and the Court of Appeals. He notes the implication of the case for the remedial jurisdiction of administrative tribunals.
