Abstract

The article discusses the tortious liability of misfeasance in public office and its relationship with constitutionality in the context of Great Britain's Crown Proceedings Act 1947. It mentions the struggles between public and private litigants and courts in determining the extent to which a public authority has to be treated as any other party wherein it has been in the torts of breach of negligence and statutory duty. The notion of misfeasance in public office is a form of tort which will apply to public officials in the law enforcement sector involved in improper collusion, improper disclosure of criminal records, and refusal to stop violence.
