Abstract
- The article focuses on understanding judicial doctrines of finality and discusses how to distinguish law of the case, res judicata, and collateral estoppel. It says that once litigation is terminated and time of appeal has run, the action is forever concluded, except with Rule 1.540 that gives court jurisdiction to relieve a party from finality. It tells that doctrine of res judicata, like the law of the case doctrine, enforces finality by discouraging relitigation of issues previously decided.
