Abstract
- The article discusses the court case, Ricci v. DeStefano, a case of race discrimination in violation of Title VII of the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment in the U.S. It provides an analysis of the case and contends that the disparate-impact provisions of Title VII are unconstitutional. The author also argues that the court should solve discrimination by declaring the disparate-impact provision of Title VII null and void.
