Abstract

The article focuses on the sovereign and jurisdictional issue of the international employee benefits law in the U.S. It explores the extraterritorial application of the Employee Retirement Income Security Act of 1974 (ERISA) to domestic and foreign workers abroad, highlighting the confusing nature of the current legal framework. It also presents proposal for an extraterritorial application model and provides consideration to the tough situation of foreign employees in the country.
