Abstract
- The article explores the statutory shrinking and stretching of the Emergency Medical and Labor Treatment Act (EMTALA) through judicial decisions in the U.S. It discusses the lack of substantive screening requirements put on hospitals and decide how the statutory erodes the Hippocratic Oath has threatened patients. It critiques the decision of the Supreme Court in Roberts v. Galen and asks whether it flies in the Congressional aim's face.
