Abstract
- This paper arises from research carried out into two aspects of the immigration and asylum decision making process in Scotland. The first aspect studied how the higher courts review the immigration and asylum decision making process. The second aspect studied participants' experiences of the process. This paper will draw on that research to explore firstly the lived experience of migrants who encounter the immigration and asylum decision making process and secondly the issues surrounding review for "error of law" in a jurisdiction where the assessment of a factual matter - credibility- is central.
