The soaring ironies of the paradox of absolute individuation in an era of globalization. Three examples of the spread of supranationality from Latin America.

Abstract

The paradox of absolute individuation has always led states to the creation of norms that violate sovereignty. This trend has exponentially increased because of globalization, which presents an unprecedented pressure to solve the paradox. Ironically, the idea that an eroded sovereignty as the best way to preserve the state, as advanced by the success of the EU, is a strategy of choice to cope with globalization. Indeed, socialization on the EU model occurred among small and medium states, which redefined their identity. To illustrate this, I study this process in 3 Latin America countries - Brazil, Argentina and Colombia-, focusing on economic integration processes (MERCOSUR, Andean Community) and their role in the creation of the International Criminal Court. I trace the beginning of these endeavors to the identification the challenges of globalization, the identification of the EU supranational model as an alternative and the consolidation of an identity change that incorporates this model via the creation of a new legal skeleton in these countries â€"court decisions, legislation and constitutional reforms and international treaties.
