EL CONSEJO SUPERIOR DE LA JUDICATURA: NI DEMOCRÁTICO NI INDEPENDIENTE.

This paper examines the way in which the proposal of Garoupa and Ginsburg, regarding the analysis of the judiciary commissions responsible for the administration of the judicial branch, the assignment of judges and disciplinary sanctions, is applied to Colombia. First, it analyses if it is suitable to refer to a tension between political independence and responsibility in the ordinary judicial system of a country like Colombia. Second, it studies the institutional design of that system. Third, it develops a scheme to achieve that both the Superior Council and the ordinary judiciary become more politically independent and responsible. Through out this paper the author concludes that in Colombia accountability can be increase without limiting the judicial independence. [ABSTRACT FROM AUTHOR]
