Abstract

The article examines the legal ramifications of marketing raw milk to the end consumer. It identifies the four legal theories wherein a plaintiff can use to recover for damages from milk including negligence and negligence per se, strict product liability for manufacturing, design and warning defects, breach of express or implied warranty, and misrepresentation. It concludes that several U.S. states view pasteurization as a cheap, effective, and proven method of reducing risks.
