Marginal Zones: Trojan Horses For Water Exports?

Abstract

As widely accepted today, law is far from being a literary science; it has geographical implications. As far as we are concern, law is powerfully involved into the creation, alteration and annihilation of space. The place of law has a end, build upon borders and spaces. Based upon scholarship relevant to the geo-legal approach (Blomley (2001, 2004), Ford (1999), Holder and Harrison (2003), Miller (1996) and Neuman (1996) our aim is to raise the issue of the non-uniformity of law, specially in political units as large as Canada. Applied to the context of water exports, we will i) bring a new light on the theoretical concept of "marginal space", drawn from Neuman's concept of "anomalous zones", ii) highlight the presence and the expansion of marginal spaces, where water is legally allowed to be exported while forbidden within the territorial jurisdiction of the provinces, and iii) argue that marginal spaces could be useful in closing up the ties between Canada and the United States. ..PAT.-Unpublished Manuscript [ABSTRACT FROM AUTHOR]
