Should Antigua Sue China?

Abstract

The article examines whether Antigua should file a complaint against China with the World Trade Organization (WTO) on the same grounds as its complaint against the U.S. over U.S. laws prohibiting Internet gambling. The WTO has substantially found in favor of Antigua, although the U.S. continues to appeal and refuses to comply. The grounds of the W TO ruling are that when a country allows one jurisdiction to permit a form of gambling, it cannot forbid it in all of them, and Nevada allows remote gambling over the telephone. China regulates Internet gambling in the exact same way. It is forbidden everywhere except Marceau and Hong Kong. Antigua would appear to have a strong case.
