Abstract
- The article discusses the U.S. Supreme Court case Navigant Consulting Inc. versus Wilkinson. The U.S. Court of Appeals for the 5th Circuit ruled that former employees, John Wilkinson and Sharon Taulman, disclosed confidential information to profit from the sale of a portion of Navigant's business to a competitor. The court acknowledged that an employee who is preparing to compete with an employer lacks a fiduciary duty under most circumstances. It held that employees must not mislead the employer because they may be liable for damages.
