Abstract
- The article discusses the constitutionality of the North American Free Trade Agreement's (NAFTA) settling of trade disputes before binational panels. According to the article, the issue is whether the panels violate Article III of the U.S. Constitution by undermining U.S. courts. Amendments to Article III are suggested by the author in order to achieve the goals of transnational adjudication. The agreement was signed by U.S. President George H. W. Bush, Canadian Prime Minister Brian Mulroney, and Mexican President Carlos Salinas de Gortari, and aims at strengthening friendship and cooperation among the member nations, creating employment opportunities, and improving living and working conditions.
