Abstract
- The approach to any study about matrimonial institution in its economical aspects requires a historic analysis to establish the foundations of the present suitable law. In this article, a general scope of historical evolution of marriage and its economy will be carried out. The aims is to highlight the legal background the marriage institution has had and the ways goods have been linked towards contracting third persons with those considered husband and wife. This study goes back to the times of Roman law, where some institutions appeared, which even though did not constitute a communitarian regime, they did have influence on the patrimonial responsibility of spouses. The analysis is centred in the common property regime. In this issue, we will get to the evolution form the origins of the institution in Rome to the Newest Compilation in Spain.
