Will There Now Be Clean Water Act Sanity?

The author explores the issues surrounding the reform of the application of the U.S. Clean Water Act's (CWA) Section 404 and the rediscovery of the 5th Amendment, in 2006. He asserts that the Supreme Court decision in the double cases of Rapanos versus the U.S. and Carabell versus the U.S. Army Corps of Engineers was another slow step in the reform. The court agreed in principle that the Environmental Protection Agency and the Army Corps of Engineers had overreached in their interpretation and application of the CWA.
