Abstract
- The article details a lawsuit involving a student at Bret Harte Union High School in California who had been accommodated by Section 504 and by the Individuals with Disabilities Education Act (IDEA) under the "other health impairment" classification. His parents claimed that the district denied an entitlement to "free appropriate public education" or FAPE. The case begins with an administrative impartial due process hearing and ends with a decision that suggests the court became impatient with both parties' actions. The case is an example of "needless adversariness" and "overlegalization" of special education.
