Abstract
- The article argues that in certain important yet understudied respects, unwritten constitutional rules play a similar role in the U.S. constitutional structure as they do in the constitution of the United Kingdom. It is also argued that there are three distinct sources of unwritten rules that are based on precedent, unwritten agreements, and generally accepted principles. These unwritten rules are made binding by custom, mores, and political difficulties and benefits.
