Las falsedades documentales de la Ley de Tránsito. Especial referencia al castigo de la falsificación ideológica.

The work examines the crimes established in articles 190 and 192 of the (Chilean) Traffic Law, particularly emphasising the punishment of so-called ideological documentary falsehoods. First, based on the legally protected interest, it seeks to determine whether these crimes present an unfair act that is partially different from the documentary falsities regulated in the (Chilean) Criminal Code. Regarding the punishment of ideological falsehoods, the paper starts from the traditional thesis, which postulates the limited penalty of this false modality whenever there is a duty of truthfulness attributable to the document's author, whether a public official or a not. Then, the paper analyses how this traditional criterion has exceptions in the falsehood types regulated in the Traffic Law and other dogmatic aspects of interest that also deviate from the regulations and general positions.
