ENTRE A AUSTERIDADE FISCAL E AS POLÍTICAS PÚBLICAS SOCIAIS: ANÁLISE DA JURISPRUDÊNCIA NEOLIBERAL DA RESERVA DO POSSÍVEL PELO PODER JUDICIÁRIO.

This is a qualitative analysis of STF decisions to identify the court's position regarding changes in budgetary control that affected public policies. To this end, it was necessary to review the following premises: a) the economic scenario that resulted in the fiscal control policy; b) the fundamental rights in the Constitution of 88 and the challenges to its effectiveness. Among these changes, the Golden Rule, the Fiscal Responsibility Law and Amendment 95/2016 stand out, which established a spending ceiling. The STF was observed in the protection of public policies for the implementation of fundamental rights in conflict with the theory of the reserve of the possible. The jurisprudence corresponds to the twentyyear period of this process, this auxiliary procedure arises from the dogmatic legal methodological analysis.
