Arbitration is a form of dispute resolution based on the free will of the parties. This figure has experienced significant growth in recent years and its popularity continues to grow, as it allows the parties to resolve disputes that may arise from their contractual relationship in an agile and rapid manner. This paper will analyse what arbitration is, the types of arbitration that can be found, what the arbitration procedure in Spain is based on, its advantages, tips on how to draft an arbitration clause, the use of arbitration in Mexico will be explained and compared with that in our country and, finally, a brief reflection on why arbitration in Spain is not so successful.
