Abstract

In this study, the nature of the principle of discretion in the Hanafi doctrine, which means to act with the most reliable and strong angle in the solution of matters in which verdicts can be reached against or in favor to free the obligant from responsibility as much as possible, has been addressed. In this context, based on the definitions made by the Hanafi canonists regarding the concept, answers to the questions of what discretion means, why it is utilized, and when and where the action was taken with discretion were first sought. Then, by determining the discretionary judgments made in the Hanafi sect and the methods and rules that led to reaching these judgments, it was attempted to reveal how action was taken with the principle of discretion in the doctrine. Accordingly, it was found that certain rules were considered while making a discretionary judgment and that the principle of discretion was closely associated with ancillary evidence such as “istihsân, istishâb, and sedd-i zerâyi”.
