Abstract

The Supreme Court has ruled in favor of a Defense Department civilian in a furlough case, stating that federal employees do not always have to appeal to the federal circuit within 60 days of a final ruling from the Merit Systems Protection Board (MSPB). The court decided that federal courts can review individual cases and determine if there are exigent circumstances that allow for more time to file an appeal.
