Abstract
- The Federal Employment Agency has certain areas of responsibility, including the calculation of subsidies for private health insurance according to § 26 (1) sentence 1 SGB II. A plaintiff demanded higher benefits to secure his livelihood, especially a higher subsidy for his private health insurance premiums. The Social Court and the State Social Court dismissed the claim because the plaintiff had no entitlement to higher benefits. The plaintiff fulfilled the eligibility requirements of SGB II but had no entitlement to further basic security benefits. The Federal Social Court (BSG) ruled that certain expenses that fall within the self-retention of recipients of private health insurance are not covered by § 26 SGB II. The plaintiff also had no entitlement to an additional hardship allowance according to § 21 (6) SGB II. In another case, the issue was the start of interest on a claim for retroactive payment of unemployment benefits (Alg). The BSG ruled that the Alg claim becomes due only with the actual receipt of belatedly paid wages. It was argued that this is justified because it is not foreseeable beforehand whether the unemployed person has actually earned a higher income.
