The article analyzes, based on primary and secondary sources, the application of the doctrine of unconscionability in state contracts. For this purpose, the paper is divided into two parts. In the first part, some general considerations on unfair terms are presented. In the second part, it is exposed the scope of these clauses in the field of government contracting in Colombia, in particular, their purpose, characteristics and the legal sanction to which they are subject.
