Abstract
- This article offers a detailed definition for the concept of precarious work, how the independent contractor classification can be misused, some brief context on the classification of independent contractors in California and Ontario, and finally an analysis of factors that influence misclassification and the rise of precarious work. Factors include the economic status of the worker, gendered and/or racialized status of the worker, the jurisdiction of the employer, and the test for classification itself. This article concludes by reviewing recent developments in this area of the law and providing predictions about possible future developments. [ABSTRACT FROM AUTHOR]
