Abstract

The article describes a court ruling by the LSG Baden-Württemberg, which states that a victim of a violent crime who cannot sufficiently describe the harmful event due to illness will not receive any easing of the burden of proof or a reversal of the burden of proof. In the specific case, it concerns a plaintiff who applied for compensation for victims under the OEG (Victims Compensation Act) due to alleged sexual abuse during her childhood. The court rejected the application because the plaintiff had not filed a criminal complaint and the statements were not considered credible.
