Abstract

This article critically examines the options for prosecuting Russian leaders for their involvement in the invasion of Ukraine. It explores the violation of the UN Charter and the potential criminal responsibility of Russia for aggression. The article discusses different international options for prosecution, including the International Criminal Court (ICC), a special tribunal, and a hybrid tribunal. It concludes that ICC prosecution would be the most practical and symbolically beneficial option, but acknowledges the jurisdictional limitations of the ICC in this case. The text also discusses concerns and challenges associated with establishing a Special Tribunal or a hybrid tribunal. Overall, each option has its advantages and drawbacks, and the choice of which option to pursue depends on various factors. [Extracted from the article]
