Abstract

The 1977 Colorado Recreational Use Statute, which grants immunity to private landowners for injuries sustained on their property, has raised concerns for owners of high peak trails. A 2019 10th Circuit decision created an exception to this immunity when there is a "willful or malicious" failure to warn of a known danger. Attempts to remove the word "willful" from the statute failed, leading private landowners to close trails or require electronic liability waivers. Property owners are worried about potential bankrupting judgments and have received warnings from their insurers. [Extracted from the article]
