Abstract
- The 1977 Colorado Recreational Use Statute, which grants immunity to private landowners for injuries sustained on their property, has raised concerns for owners of high peak trails. A 2019 10th Circuit decision created an exception to this immunity when there is a "willful or malicious" failure to warn of a known danger. Attempts to remove the word "willful" from the statute failed, leading private landowners to close trails or require electronic liability waivers.
