Abstract

The Main Objective of this Article is to Analyze the Implications, Limits, and Possibilities of the Axiom Commonly Found in Legal Literature, that Law is Defined by Being a Technique for the Organization of Social Life. The Implemented Methodology is Based on Bibliographic and Documentary Research. The Text is Divided into Three Axes: i. an Analysis of the Meanings that can be Extracted from the Term ‘Technique’ in Some Legal or Juridical Texts in a Broad Sense; ii. a Research on the Boundaries and Scope of Notions of ‘Technique’ in Anthropology and Sociology, Drawing on Authors like Mauss, Marx, and Weber; iii. Clues for a Critical Reflection, from the Social Sciences, on the Breadth of the Idea of Legal Technique. The Found Results Demonstrate that the Notion of Technique Appears with Plural Meanings in Legal Studies as well as in those of the Social Sciences. As the Main Conclusion, it is Worth Noting that the Understanding of Legal Technique, as well as the Expression of Technique in General, Cannot be Taken in a Unambiguous, Hermetic, or Self-Explanatory Manner.
