Abstract

Legal processes take into account the mental state of a person at the time of committing a crime to determine their responsibility. Having a mental disorder in Ecuador is a cause of non-imputability, although there is no catalog of these as causes of non-imputability. The objective of this research was to determine the concordance between the expert diagnosis and the diagnosis established by the Institute of Neurosciences of the Guayaquil Charity Board in people declared inimputable, interned by court order during the period 2013-2022. The methodology is quantitative, descriptive in scope and non-experimental design. The population is 142 participants. The results showed that most of the people declared inimputable are men, between 18 and 34 years old, single, from the coastal region, unemployed and with a low socioeconomic level; crimes against life and personal integrity were the most common. It was found that the concordance between the expert diagnosis and the diagnosis assigned by the Institute of Neurosciences was low, which causes problems in terms of diagnostic reliability; however, the concordance between the hospital admission diagnosis and the hospital discharge diagnosis was good.
