Abstract
- The Unfair Contract Terms Directive (UCTD) is a foundational piece of legislation in European Contract Law that has been in effect for over 30 years. Despite its importance, the UCTD has never been reformed to address the challenges of digitalization, sustainability, and global issues. The directive has contributed to the integration of fundamental rights into European Contract Law and has been a source of uncertainty due to its two-level system. Two key issues related to the UCTD are the information model and legal consequences, particularly regarding nullity and restitution.
