Abstract

The irruption of reproductive technology has changed procreation by breaking the biological fabric contemplating the participation of third parties. In the field of reproductive medicine, surrogacy is the most controversial practice for three reasons: it calls into question the old Paulian principle mater semper certa est, since the determination of maternal affiliation would no longer be made as a result of the biological fact of the childbirth and would obey the mere will of the intended parents; it offers a livelihood to women in a situation of economic precariousness; and makes children the object of commercial transactions. The lack of consensus on its admissibility and regulation has led to legal gaps and legal divergences, giving rise to a new global phenomenon, the so-called «reproductive tourism», which allows States to be classified between exporters of intended parents and providers of surrogate mothers. This classification coincides with the differentiation between developed and developing countries, and highlights the vulnerability of women to surrogacy. [ABSTRACT FROM AUTHOR]
