Capital markets are special financial platforms where a wide variety of economic agreements are made on a national and international scale, commercial and economic relations are established, the interests, gains and losses of all individual and institutional investors are directly changed, and therefore the national economic security, development and stability of a country can be affected. The fact that capital markets are very important and yet so sensitive reveals the need to fully and completely understand the activities that may harm these markets. There is no doubt that the leading of such harmful activities is the crime of market fraud that is regulated in Article 107/1 of the Capital Market Law. Knowing all the structural features of this special genre of crime, especially the material and moral elements, and recognizing the strengths and weaknesses in the current regulation are of great importance both in fighting this crime and in revising the existing regulations appropriately. In this way, the crime of market fraud, which is one of the biggest obstacles to the development of our country, will be prevented and the damages suffered by the victims will be eliminated.
