Abstract

While rarely recognized as such by labor scholars, these decisions were an important part of the deregulatory push of the neoliberal era, as they put increasing numbers of workers outside the protection of labor and employment laws and into the far more employer-friendly terrain of contract law and a new big business-friendly antitrust law.
