Abstract

The article presents a comparative study on insolvency crimes in Chile in relation to insolvency criminal legislation in the United States, Germany, and Spain. The criminal regulation of insolvency in each country is analyzed, highlighting the differences in bankruptcy processes and punishable behaviors related to asset concealment. The reforms to bankruptcy legislation in Spain and Chile are discussed, as well as the importance of harmonizing insolvency criminal law with bankruptcy legislation. The need for punitive reinforcements to prevent criminal behaviors related to insolvency is also raised. The article concludes that the existence of insolvency criminal law is necessary to protect creditors and highlights the increase in these crimes in different countries. [Extracted from the article]
