Article 318 bis, the only precept of Title XV bis of Book II of the Penal Code, bears the heading "crimes against the rights of foreign citizens", but are the rights of foreign citizens the ones that are being protected by this precept? Through the systematic analysis of crimes against the rights of foreign citizens and, dwelling on each of its elements, we reach a very different conclusion, which has required a special analysis of the protected legal right, of the different problems that have raised this criminal figure and the supranational regulations that have guided the steps of the Spanish legislator in the matter.
