We shall discuss in this paper the elaboration of 1890 Penal Code since the initial discussions for the replacement of 1830 Criminal Code, passing through its promulgation in the Provisional Republican Government to the receptivity among the magistrates. Throughout our analysis, we shall highlight Article 157 of 1890 punitive laws because it criminalized Spiritism. Through the analysis of historical sources, we shall discuss how the 1889 draft written by João Vieira de Araújo was organized to replace the 1830 Criminal Code and the refutation of this draft; the production of 1890 Penal Code by João Baptista Pereira and the lack of receptivity of the new penal laws among Law professionals; the attempt to replace the punitive system in a new draft by Vieira de Araújo in 1897; the positioning of the Brazilian Bar Association with the participation of Baptista Pereira; the considerations of the legislator of the Penal Code in defense of his work; and the new attempt to replace 1890 Penal Code by Galdino Siqueira in 1913.
